PLATINUMTEL WIRELESS SPEARHEADS AND WINS LANDMARK FEDERAL COURT RULING IN PREPAID WIRELESS, ADVOCATING FOR CONSUMERS’ RIGHTS
Federal Court Charges EZ Stream, Inc. $15 Million for False Advertising and Consumer Fraud
Chicago, IL – PlatinumTel Wireless, a nationwide prepaid wireless provider that operates on a 3G Network that reaches 280 million people, announced today they won a federal court ruling for consumer rights in the prepaid cellular industry against EZ Stream, Inc.
On April 27, 2010, the Federal Court ruled in favor of PlatinumTel and against EZ Stream, Inc., U.S. Mobile, Inc., Quick Com, Inc., Quick Com II, Inc., Quick Com Cellular Corporation, EZ Com, Chicago, Inc. d/b/a Quick Com Chicago and Ramsey Natour under the Lanham Act and Illinois Consumer Fraud Act alleging among other things, false advertising, and deceptive practices. PlatinumTel was awarded a judgment of $15,340,089.70, which includes monies for both compensatory and punitive damages.
This lawsuit marks a major landmark ruling in the prepaid wireless industry and for consumers’ rights and advocacy. It follows several lawsuits that were filed in past years shedding light on fraudulent consumer marketing of prepaid phone cards used for international calling as well as more recent lawsuits filed by consumers against larger post-paid carriers for deceptive practices.
“Consumers were clearly being taken advantage of and PlatinumTel felt it was our responsibility to fight against this consumer fraud with legal actions,” says Omar Aqel COO at PlatinumTel. “Our efforts successfully protected the customers by stopping the defendants’ cheating and simultaneously helped to maintain and protect the honesty, integrity and legitimacy of the prepaid space. Moving forward, we hope that we at least made it very difficult for any service provider to deceive their customers with manipulative billing practices, especially within the prepaid realm.”
Aqel continues, “as a result of this legal outcome, retailers will now have more confidence in the MVNO partners and there is less risk for potential liability due to dishonest practices. PlatinumTel orchestrated this for the good of the industry and will remain an advocate for consumers and retailers alike.”
PlatinumTel filed a Complaint in the United States District Court for the Northern District of Illinois against U.S. Mobile, Inc. and EZ Stream, Inc., individually alleging false advertising under §1125(a) the Lanham Act, violations of the Illinois Consumer Fraud Act and violations of the Illinois Uniform Deceptive Trade Practices Act in connection with prepaid wireless services. PlatinumTel alleged that the defendants’ false advertising significantly and routinely misrepresents the minutes available under their prepaid wireless programs sold to consumers and in making these allegations sought to protect consumers from abuse.

PlatinumTel Launches New Identity, Products

PlatinumTel announced today the release of its new identity along with the launch of an updated web site featuring the new image. "This project was exciting to work on and we're hoping that our large audience enjoys the new brand look that sets PlatinumTel apart," said Omar Abhari, Director - Business Development & IT for PlatinumTel. "Ultimately, our goal is that our new brand identity will allow subscribers to more easily identify with the brand and make educated product purchases that best fit their lifestyle needs. We felt that our brand needed to have more meaningful connection with our subscribers and more effectively convey what makes our products and our company so very unique. A subscriber could maintain a prepaid cell phone for $5 a month on the low end, or even purchase a full year of service in advance for $100 which alots 1500 to the subscriber for the duration of the service.
